Dear Minister Mitchell,

I have previously written to you on this matter and, unsurprisingly, have received no substantive response.

Attached again is the forensic report concerning the Christchurch Mosque Attack video. The report concludes that the video relied upon as part of the official narrative is not authentic. Police were notified as early as 2019 that there were serious concerns regarding the video's authenticity and that it should not be relied upon in any related proceedings.

Following extensive forensic examination conducted overseas, the preliminary concerns have now been conclusively validated. The findings directly contradict the official Government and Police account of events.

Anyone with a working knowledge of firearms and ballistics understands that a projectile striking a target produces observable and measurable effects. Those effects are conspicuously absent throughout the video. This raises fundamental questions that have never been adequately addressed.

At the same time, I am facing charges carrying penalties of up to 14 years' imprisonment for allegedly sharing a link to the foreign investigative documentary website "The Three-Faced Terrorist." The link in question was allegedly shared on or about 22 February 2022, yet the material was not classified as objectionable until 10 March 2022. On that basis alone, the prosecution raises serious legal and factual concerns.

The public is entitled to know whether evidence relating to the Christchurch attack has been misrepresented, suppressed, or shielded from proper scrutiny. Confidence in both Government and Police institutions depends upon transparent answers, not continued silence.

Accordingly, I formally demand a genuinely independent criminal investigation into the handling of evidence and the broader Christchurch Mosque Attack narrative. Such an investigation cannot involve individuals or agencies responsible for the original inquiries, as any review conducted by those connected to the matter would lack credibility and public confidence.

I also request an immediate reassessment of the charges against Hannah Spierer and myself, with a view to their withdrawal. Significant additional information will shortly enter the public domain, further exposing serious questions regarding the conduct of Police and Government agencies in this matter.

The public has endured years of obfuscation, institutional protectionism, and unanswered questions. That cannot continue indefinitely.

I expect a substantive response addressing the issues raised rather than a routine acknowledgement of receipt.

The Police Commissioner, Police Media Team, and other relevant parties have been copied into this correspondence in the interests of transparency and accountability.

As members of the genuine media, our responsibility is to hold those in positions of power accountable on behalf of the public. We intend to continue doing so regardless of the pressures, allegations, or proceedings brought against us.

I was one of the Senior Investigating Officers assigned to this investigation and therefore have comprehensive knowledge of the evidence and facts pertaining to the case.

After reviewing the material you provided, I am satisfied that it lacks any credibility and does not warrant any further investigative action. Accordingly, Police will not be conducting any further investigation into this matter and will not be entering into any further correspondence concerning it.

Firstly, is the opinion expressed in your email your personal assessment, or does it represent the official position of the New Zealand Police? If it is the official position, please confirm that explicitly.

Secondly, your email appears to reject the findings of an independent digital forensic analyst who has produced a detailed technical report. Could you please identify the qualifications, training, and experience upon which you rely to reach a contrary conclusion regarding the digital forensic evidence? In particular, I ask whether you possess recognised qualifications or specialist expertise in digital video forensics, forensic image analysis, video encoding, compression artefact analysis, or other relevant forensic disciplines that would enable you to competently assess and dismiss the report.

Alternatively, if your conclusion was based upon advice from another person or unit possessing those specialist qualifications, please identify:
  • whether the report was independently assessed by a suitably qualified digital forensic expert;

  • the agency or unit that conducted that assessment; and

  • the qualifications and expertise of the person or persons who reached the conclusion that the report lacked credibility.

Your response does not identify any technical errors, methodological flaws, or evidential deficiencies within the forensic report itself. Instead, it simply states a conclusion. Given the significance of the matters raised, including the integrity of evidence relied upon in one of New Zealand's most significant criminal investigations, it is reasonable to expect that any decision rejecting specialist forensic evidence would itself be supported by appropriate forensic expertise.

I also note your statement that Police will not enter into further correspondence concerning this matter. If that statement represents the official position of New Zealand Police, despite the existence of an independent forensic report raising issues concerning evidential integrity, I ask that you confirm this explicitly so that your response accurately reflects the position adopted by the organisation.

I look forward to your clarification.
